requirement. guardian/nominee should be able to provide the consent on the data principal behalf. This will require DP to honor the consent given by the nominee/guardian.

Nominee use case
DP knows the data principal as he has a relation with the DP. Users nominee needs to be trusted by the DP to honor the consent given by the Nominee.
Also a nominee will usually give a consent when the user is not in the position to share the consent. This can be a case when user is not well, not alive and so on...
Requirements:-

  1. DP should be able to honor consent given by the nominee.
  2. DP may or may not know about the nominee in advance.
  3. The special circumstances need to be valid for the nominee to give consent.
  4. one can have multiple nominees and can given consent within a context.
  5. A nominee should approve the request from the user to be his nominee.
  6. A user should define the context in which nominee can give consent.

Usually these special circumstances are known to the nominee and/or the DC/DP. like

  • user is hospitalized. here nominee and DC (doctor/hospital/lab) know about this.
